Georgia Supreme Court Says Left Turn Law Too Confusing

The Supreme Court of Georgia ruled last week that the Georgia Legislature's improper left turn statute is "unconstitutionally vague."  Justice Carol Hunstein wrote that the plain reading of the statute leads to two completely opposite interpretations that people of "common intelligence" cannot reconcile.  The court was hearing a criminal case for DUI and improper left hand turn.  Fortunately, the case did not involve an auto accident or injury. The statute in question prohibits making a left hand turn into the right lane of a multi-lane roadway.  It begins by instructing drivers to be in the far left hand lane  before making a left turn, which seems reasonable.  The statute then, according to Whitfield County Public Defender Benjamin Goldberg, becomes incomprehensible. For now, police officers cannot hand out tickets for improper left turns.  The Georgia Legislature will have to fix the law when they return to session next year.  This ruling is important to Atlanta Personal Injury Attorneys because it is used to establish a legal duty.
