Girl Pinned Under Car at Sandy Springs Whole Foods

As a 9 year old and her mother were leaving the Whole Foods on Roswell Road in Sandy Springs,  which is a suburb of Atlanta, Georgia a 70 year old driver had an accident and lost control of his  car and backed into a cement planter, toppling it over onto  a young girl.  Fortunately, officers reported the planter took most of the impact from the car, but the girl was trapped until emergency help arrived.  She was taken to Children's Heatlhcare of Atlanta at Scottish Rite  hospital for treatment of non-lifethreatening injuries.  It appears the older driver will be liable for her injuries, depending on the reason he lost control of the vehicle.  If he suffered an unforeseeable medical condition, such as a stroke or heart attack, without warning, he might not be  liable.  If, however, he was looking for his cell phone or otherwise distracted, he was driving negligently and will be liable for any damage he caused, both to property owned by the store and for injuries to the girl.  If you or a loved one have been injured by the negligence of another, please contact Kaufman Law at 888-973-2540 (888-WRECK-404) to schedule a free initial consultation.
